After seven years of involvement with City staff, including an application filed in 2021, Mark Garey is seeking an exception to environmental regulations to build on land containing Lyon Creek, steep slopes, and protected habitat.
Neighbors have documented flooding, substantial hillside runoff, erosion, and a history of sinkholes. Excavation associated with the property has already resulted in sewer damage and nearly $30,000 in repair expenses for two neighboring households.
Yet City staff now recommends conditional approval.
Are the studies current and accurate? Have the flooding and slope hazards been adequately evaluated? What protects neighbors from further damage?
The law places the burden on the applicant to demonstrate that the project meets the requirements for approval — not on neighbors to prove they will be harmed.
